Women's Discrimination Daymare: 14th Ammendment of the U.S. Constitution does not protect against discrimination on the basis of gender or sexual orientation

In an article that literally made me choke on my morning coffee here @ Beck’s Cafe, it was reported in the Huffington Post that Justice Scalia noted that:

“The equal protection clause of the 14th Amendment to the U.S. Constitution does not protect against discrimination on the basis of gender or sexual orientation, according to Supreme Court Justice Antonin Scalia.”

I actually couldn’t believe Justice Scalia actually said that so I skipped over to the actual interview at California Lawyer and that’s in fact what he said.

I don’t think this reflects Justice Scalia’s actual views; in fact reading the original article tells me that. But his apparent strict adherence to our Constitution (a good thing) compels him to tell it like it is; “Certainly the Constitution does not require discrimination on the basis of sex. The only issue is whether it prohibits it. It doesn’t.”

To me, over one cup of coffee, his admonition near the end of the interview is very important, that is, as citizens, if we want change, we must, “Persuade your fellow citizens it’s a good idea and pass a law. That’s what democracy is all about. It’s not about nine superannuated judges who have been there too long, imposing these demands on society. “
